Legal Basis and Application of Privacy Policy
From 21 December 2001, ASRI will comply with the law and the National Privacy Principles ("NPPs") (subject to any other provisions of law). The NPPs are contained in the Privacy Act 1988 (Commonwealth) and regulate the manner in which personal information is managed.
Personal information is information or an opinion, in any form and whether true or not, about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion. There are further special provisions which apply to the collection of some personal information which is known as sensitive information. This includes health information and information about a persons' race, ethnic origin, political opinions, membership of political, professional or trade associations, religious or philosophical beliefs, sexual preferences and criminal history.
This privacy policy applies to information collected about ASRI members and to others who form a relationship with ASRI, such as purchasers of ASRI merchandise.
How ASRI Manages Your Personal Information
1. Collection of Personal Information by ASRI
ASRI is required to collect certain personal information about ASRI members under Corporate laws. The kinds of personal information we collect and store about our members may include (amongst other things):
- personal information you give us when you request a product or service from us. This information may include your name, address, telephone number, e-mail address, date of birth, gender, details of your purchases, renewal fees and change of any of your details, credit card details and purchase requests;
- communications between members and ASRI management; and
- transactional information about your use of ASRI services
2. How Your Personal Information Will be Used
ASRI collects your personal information so that we can use it for functions and activities including:
- providing our products or services including registering your details for access to our online forums;
- to enable us to send correspondence to you by electronic or surface mail;
- to enable us to accurately notify you of ASRI-related issues;
- to facilitate contact with you;
- to seek your participation in ASRI projects;
- confirming your identity (eg. when you wish to use our products or services);
- addressing any feedback or complaints you may have;
- answering any queries you may have;
- any purposes for which it was requested and directly related purposes, monitoring and developing, improving and developing our products and services; and
- to comply with any mandatory requirement of law.
3. Consent
ASRI will assume that you consent to the management of your personal information in the manner specified in this policy (which may change from time to time) until you inform ASRI otherwise.
4. Use and Disclosure of Personal Information
If ASRI uses or disclose your personal information for a purpose (the 'secondary purpose') other than the main reason for which it was originally collected (the 'primary purpose'), to the extent required by law, we will ensure that:
- the secondary purpose is related to the primary purpose of collection (and directly related in the case of sensitive information), and you would reasonably expect that we would use or disclose your information in that way; or
- you have consented in the manner referred to above to the use or disclosure of your personal information for the secondary purpose; or
- the use or disclosure is required or authorised by or under law; or
- the use or disclosure is otherwise permitted by law (for example, as a necessary part of an investigation of suspected unlawful activity).
5. Disclosure of Personal Information to Third Parties
Personal information we collect from you may be disclosed:
- to any entity to which we are required under law to disclose such information (for instance, Federal or State law enforcement agencies and investigative agencies, courts, various other Federal or State government bodies);
- to other parties, only after written consent is received from you expressly issuing consent for us to do so.
6. Access to Your Personal Information Records
You can ask to obtain access to your personal information that ASRI holds, although under some circumstances permitted by law, ASRI may not provide such information to you.
In some instances we may require you to submit a written request to gain access to certain personal information. This is done to ensure that that your information will only be released to authenticated parties.
It is important to ASRI that the personal information held about you is accurate, complete and up to date. If you become aware that this is not the case and would like your personal information corrected, or simply desire access to your personal information, please contact ASRI.
If ASRI decides not to correct or provide you with access to your personal information, ASRI will provide you with reasons for the decision.
7. Complaints about Privacy
If you have a complaint about the way ASRI has dealt with your personal information, please contact ASRI. ASRI will make all reasonable attempts to respond to your complaints or requests.
If you are not satisfied with how ASRI handles your complaint, you may refer the matter to the Office of the Federal Privacy Commissioner.
Policy Implementation
ASRI's privacy policy is implemented in how ASRI handles and stores hardcopy and softcopy records and how the ASRI website is managed.
Policy Review and Approval
This ASRI policy was formally approved by the ASRI Board of Directors on [NOT YET APPROVED]. Amendment will be in response to changes in applicable law and as considered necessary by ASRI.
